What debts can't Merion recover?

For businesses

Merion specialises in commercial debt recovery — debts between businesses. There are some categories of account we are not the right firm for, and it is worth knowing these upfront.

  • Consumer debts — debts owed by individuals acting in a personal (non-business) capacity. These are governed by different rules and require a different approach. We do not accept consumer debt referrals.
  • Overseas debtors — our core work is within Australia. Accounts where the debtor is located overseas are complex and are assessed individually rather than accepted as routine work.
  • Statute-barred debts — if the limitation period has expired (generally six years from when the debt was due in most states), legal proceedings can no longer be commenced. We may still be able to assist with older accounts, but we will be honest about the limitations.
  • Disputed ownership — if there is a genuine dispute about whether the debt belongs to the client referring it, or if the underlying contract is disputed, we will need to assess the account before accepting it.
  • Debts subject to insolvency — if the debtor is in liquidation, voluntary administration or bankruptcy, recovery must follow the insolvency process rather than standard collection.
