What is a commercial debt?

A commercial debt is a debt that arises between two businesses — for example, when one business supplies goods or services to another on credit, with an invoice due within agreed terms, and that invoice is not paid.

This is different from a consumer debt, which arises between a business and an individual acting for personal purposes. Commercial debts are common in everyday trade: suppliers, contractors, wholesalers and professional service providers all routinely deal with accounts that go overdue.

The rules that apply to commercial debt collection in Australia are set out in the ACCC and ASIC debt collection guideline. Even as a business debtor, you have rights — including the right to dispute a debt, request verification, and raise hardship if relevant.
