Can Merion garnish my Centrelink payments?

In most circumstances, Centrelink payments and other social security payments are protected from garnishment. A garnishee order is a court mechanism that diverts money from a third party — such as an employer or bank — directly to a creditor, and it generally cannot be applied to Centrelink payments themselves at their source.

However, there are some nuances worth understanding:

  • If a court judgment has been obtained against you and Centrelink funds are mixed with other money in a bank account, a garnishee over that bank account can be more complicated to navigate in practice.
  • The rules vary depending on the type of payment and the state in which any proceedings are brought.
  • Voluntary deductions from Centrelink — such as Centrepay — are different from legal enforcement and are arranged by the recipient, not imposed.
